Advertiser terms
Last updated 24 October 2026
These terms apply to businesses that contact Saratoga Games, which owns and runs Smaz Games (smazgames.com), about advertising or sponsorship. We are based in Plattekloof, Cape Town, South Africa. The Acceptable use policy also applies.
Enquiries and orders
Smaz Games does not offer self-serve advertising. Sending an enquiry is a request to discuss a campaign. It is not a booking and does not create a contract.
A campaign goes ahead only when both sides agree a separate written order. The order sets out the advertiser, who pays, the placements, dates, countries, price, budget, what is counted for billing, how delivery is measured, payment and cancellation. If the order and these terms conflict, the order applies, except that it cannot override the content and privacy rules below.
An agency must tell us who the advertiser is and confirm it has the authority to act for them.
Display ads served on the site by Google AdSense are covered by Google's own policies, not by these terms.
Labelling
Every ad and sponsored placement is labelled as advertising, and it must be easy to tell apart from games and the rest of the site. Ads appear on the site around games, never inside them. Paying for a campaign does not affect which games we approve or how we rank them.
Content rules
Ads, and the pages they link to, must:
- Be accurate, lawful and able to back up their claims.
- Not imitate game controls, download buttons or system warnings.
- Not use pop-ups, pop-unders, forced redirects, autoplay sound, malware or tracking we have not approved.
- Not be for adult content, gambling, tobacco or vaping, illegal drugs or weapons, high-risk financial products, predatory lending or political campaigns.
- Not be directed at children.
We review every creative and landing page before a campaign starts, and again when anything changes. We may reject, pause or remove an ad that breaks these rules, and we will tell you why where we can.
Targeting and data
Campaigns are targeted by context, such as the game or page, not by personal profiles. We do not target ads at children, and we do not use profiling to target players known to be under 18. We do not give advertisers player emails, account details, saves, friend lists or other personal data. Reports show campaign totals, never individual players. Third-party tracking or measurement code needs our approval first and is used only where the player's consent choices allow it.
Your materials
You keep ownership of your ads and brands. You give us a non-exclusive licence to display the approved creative during the campaign and keep copies we need for billing and records. We may resize or re-encode it for technical reasons but will not change its message without your approval. You confirm you have the rights to everything in your ads.
Delivery and reporting
We do not guarantee any number of players, views, clicks or sales unless the order says so. Delivery and billing follow the measurement the order names. If a guaranteed campaign under-delivers, the order says how it is made up or refunded.
Payment and cancellation
Payment terms, refunds and cancellation are set in the order. We do not charge hidden fees and campaigns do not renew automatically.
Liability
To the extent the law allows, neither party is liable to the other for indirect or consequential loss, including lost profits. If a third party makes a claim against us because of your ads, claims, landing pages or tracking, you are responsible for the reasonable costs that result. Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including for gross negligence or wilful misconduct.
Governing law
These terms and each order are governed by the law of South Africa, subject to any mandatory laws that apply to you.
Changes
We may update these terms. Changes do not apply to an order already agreed unless both sides agree in writing.
