Copyright and intellectual property
Last updated 24 October 2026
Smaz Games (smazgames.com) is owned and run by Saratoga Games. We are based in Plattekloof, Cape Town, South Africa. Games on Smaz Games are made by us and by other developers, who confirm they have the rights to everything they submit. If you think a game, its artwork, video, description or another part of a listing infringes your copyright, trademark or other intellectual property, tell us using the steps below.
This page covers take-down notices under section 77 of South Africa's Electronic Communications and Transactions Act, and notices sent under the US Digital Millennium Copyright Act (DMCA) or similar laws.
How to send a notice
Email [email protected] with the subject "Copyright notice". Include:
- Your full name, postal address, phone number and email address. If you act for the rights owner, say so and give their name.
- The work or right you say is infringed, such as a game, artwork, music, character or registered trademark. Include a registration number if there is one.
- Where the infringing material is on Smaz Games, with the full web address of each game page or item.
- What you want us to do, such as remove the game or a particular image.
- A statement that you believe in good faith that the use is not authorised by the rights owner, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury where that applies, that you are the rights owner or authorised to act for them.
- Your physical or electronic signature. A typed full name is accepted.
We may ask for more information if the notice is incomplete. We reply to the email address you give.
What we do
When we receive a complete notice, we:
- Review it and, where it appears valid, remove or disable access to the material, usually by unlisting the game or removing the item.
- Tell the developer who submitted the material, and send them a copy of the notice. The copy may include your name and contact details so they can respond to you.
- Tell you what we did.
We may also remove material on our own if we believe it infringes someone's rights.
Counter-notice
If you are the developer and you believe the material was removed by mistake, or that you have the right to use it, you can send a counter-notice to [email protected] with the subject "Counter-notice". Include:
- Your full name, postal address, phone number and email address.
- The material that was removed and where it appeared before removal.
- A statement, under penalty of perjury where that applies, that you believe in good faith that the material was removed by mistake or misidentification, with your reasons.
- A statement that you agree to the jurisdiction of the courts where you live or, if you live outside the United States and the notice was sent under the DMCA, of any court where we may be found, and that you will accept service from the person who sent the notice.
- Your physical or electronic signature.
We send a copy of the counter-notice to the person who sent the original notice. If they do not tell us within 10 to 14 business days that they have started court proceedings, we may restore the material. We are not required to restore anything.
Repeat infringers
We close the developer and player accounts of people who repeatedly infringe other people's rights, and we may refuse further submissions from them.
Misuse
Only send a notice if you own the rights or are authorised to act for the owner. Under section 77 of the Electronic Communications and Transactions Act, a person who knowingly makes a false statement in a take-down notice is liable for the damages it causes, and the DMCA has a similar rule. We may ignore notices that are clearly abusive, and we may report them.
This page does not give legal advice. If you are not sure whether something infringes your rights, consider getting advice before sending a notice.
Other problems
For problems that are not about intellectual property, such as a broken game or harmful content, use the “Something not right? Report it” button on the game page or see the Acceptable use policy.
